12.2              The limitations and exclusions of liability set out in this Section 12 and elsewhere in these terms and conditions:

(a)                   are subject to Section 12.1; and

(b)                  govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

12.3              To the extent that our website and the information and services on our website are provided free of charge, we will not be liable for any loss or damage of any nature.

12.4              We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

12.5              We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

12.6              We will not be liable to you in respect of any loss or corruption of any data, database or software.

12.7              We will not be liable to you in respect of any special, indirect or consequential loss or damage.

12.8              You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).

17.2              The exercise of the parties’ rights under these terms and conditions is not subject to the consent of any third party.

21.1              We take the protection of our copyright very seriously.

21.2              If we discover that you have used our copyright materials in contravention of the licence set out in this notice, we may bring legal proceedings against you, seeking monetary damages and/or an injunction to stop you using those materials. You could also be ordered to pay legal costs.

22.1              You may request permission to use the copyright materials on our website by writing to us by email or post, using the contact details published on the website.

Refunds Policy

  1. As PlantPlots is offering non-tangible irrevocable goods we do not issue refunds once the order is accomplished and the product is sent. However, we realize that exceptional circumstance can take place with regard to the character of the product we supply therefore we do honour requests for the refund on the following reasons:

(a) Non delivery of the product: due to some mailing issues of your email provider or your own mail server you might not receive a delivery e-mail from us. In this case we recommend contacting us for assistance. Claims for non-delivery must be submitted to PlantPlots in writing within 7 days from the order placing date. Otherwise the product will be considered received and downloaded;

(b) download and unzipping issues: it may happen so that you are having problems whilst downloading or unzipping. Claims regarding such issues must be made to PlantPlots within 7 days. If you do not properly contact us during this period, you agree that we may construe silence as a successful download of a product with no further right to redress or refund for a “download issue|” reason;

(c) major defects: although all our products are vetted before release, unexpected errors may occur. Such issues must be submitted to PlantPlots for our approval, we reserve the right to rectify the error within 72 hours. If an error is approved and we fail to correct it within 72 hours from the date or the initial customer notification, the refund will be issued to the customer in full without any compensations or reimbursements; or at the customers choice, replacement of the product for the same or around the same can be offered.

(d) product not as described: such issues should be reported to PlantPlots within 7 days from the date of purchase. Clear evidence must be provided proving that the purchased product is not as it is described on the website. Complaints which are based merely in the customers false expectations or wishes are not honoured.

Please note that we do not bear any responsibility and therefore we do not satisfy any refund/return/exchange requests based on the incompatibility of our products with some third-party software (plug-ins, add-on modules, search engines, scripts, extensions etc). We do not guarantee that our products are fully compatible with any third party programs and we do not provide support for third-party applications.
